CPOA RULES AND REGULATIONS

 

GENERAL

 

 

A.                  PURPOSE:  To provide owners and guests General Rules extracted for CPOA Declaration  of

Restrictions and Bylaws for ready reference.  Owners must obtain current copies of CPOA’s Declaration of Restrictions, Bylaws, Rules and Regulations, from the Business Office, and become familiar and use them for specific guidance.

 

B.                  NAME BADGES:  Name badges are required for admission to any Caliente facility and to

purchase tickets for meals or events.  Exceptions are church services, private social functions, Country Store, and events that require an admission fee at the door.

 

1.                    Owners:  Permanent badges are obtained at the Business Office.  Annually

one sticker will be issued, without charge, to each registered owner of

Caliente when they check into the Park.  The sticker will be placed on the name badge and will be color coded by year and identify the winter season (i.e. “00”).

 

2.                    Renters:  Temporary badges for renters and guests are obtained at the Business

Office when registering into the Park.  Temporary badges and vehicle passes

must be returned to the Business Office upon departure.

 

3.                    Long Term Renters:  Are identified as renters who have rented lots for three

or more consecutive months for two or more years.  Long term renters may purchase permanent badges at the Business Office.  These badges will be stamped with an “R" to indicate a renter and an annual sticker will be issued for twenty-five (25) cents each to be identified for the winter season (i.e. “00”).

 

4.                    Guests:  Temporary badges for registered guests are obtained at the Business

Office.  these badges will be issued for the specific duration of the guests’ stay

in the park.  There will be a 50 (fifty) cent charge for each badge.

 

C.                  SMOKING:  No smoking is permitted inside any CPOA Building.

 

D.                  AGE RESTRICTIONS:  Each occupied Unit shall be occupied by at least one person 55

years of age or older with no person less than 40 years of age residing in the Unit. The use of each Unit shall be limited to two (2) adults including multiple lots joined together.  Multiple lots are defined as follows: Individuals must make application to the County Assessor’s Office to legally change the size of the recorded lots to one 60' x 40'  instead of 2 lots 30' x 40'.  This eliminates the middle property line making it possible to add a larger Arizona Room and, also, to incur one tax bill.  Setbacks on the sides will still be the same; two on the left facing the street and one on the right facing the street.  Combined lots will still be subject to two annual  assessments and two, if any, special assessments.  Under age 55 owners will be allowed to reside on their lot(s) up to a total of two weeks a year for inspection and maintenance purposes. Multiple ownership of one or more lots and ownership of multiple lots will still be limited to a cumulative total of two weeks a year.  Registration at the Business Office is required.

 

E.             GUESTS:   All guests who will use any CPOA facility, including children of residents, must

                register at the Business Office for each visit.  Guests’ visits are limited to one week.  Visits for

longer periods must be approved by the CPOA Board of Directors or its appointed representative.

Non-resident owners, defined as any lot owner in good standing with all assessments paid, but

who does not reside in the Park, must register and accompany any guest using any CPOA facility.

F.             TEMPORARY DEPARTURES:  All residents (owners and renters)  will notify the Business

Office when departing from, or returning to, the Park for an absence of more than one day.

 

G.                  TELEPHONE MESSAGES:  EMERGENCY ONLY telephone messages will be taken at

the Business Office (520/868-5520) and delivered to you.

 

H.                  TRUCK CAMPERS:  Campers will be completely self-contained and will remain on the

pickup truck at all times.  (Self-contained means having its own toilet, tub/shower, kitchen sink, etc.).  Units must be connected at all times to the sewage disposal and water supply system provided at the site if used as a residence.

 

I.                     TENTS:  No tent trailers, tents or tenting permitted anywhere in the Park.

 

J.                   QUIET TIME:  Quiet time in the Park is from 10:00 p.m. to 7:00 a.m.

 

K.                  PETS:  See Rules and Regulations for Pets.

 

L.                   LAUNDRY:  No outdoor clothes lines permitted.  Laundry facilities are located at each

swimming pool facility.  Five (5) minutes after an occupied laundry machine (washer or dryer) completes it’s normal operating cycle, a waiting user has Board of Directors permission to carefully remove garments from the stopped machine and proceed to use the machine.

 

M.                 GARBAGE:   CPOA has centralized garbage pickup.  Bagged and tied household

garbage ONLY must be placed in the containers in front of Annex along the oleanders.

The Town of Florence will dump the containers as requested by the CPOA Park Manager.

Trash (boxes, clippings, packing materials, wood, furniture, etc.) will be picked up at individual lots on the first and third Tuesday of each month.

 

N.                  CONSTRUCTION:  See Rules and Regulations for Construction and Building Permits.

 

O.                  HOUSE NUMBERS:  House Numbers shall be prominently displayed on the front of each

Unit including RV’s,  preferably using large numerals with luminous paint.

 

P.                   FENCES:  A fence is not permitted on any lot.  A trellis may be used for flowers, but cannot

block access to the utility pedestal.

 

Q.                  BICYCLES:  No bicycles or in-line skates allowed on sidewalk around the Clubhouse or

within swimming pool and shuffleboard enclosures.  Bicycles may be ridden through the bicycle pathway on the south side of the Annex between  the Clubhouse parking lot and Cholla Lane.

 

R.                  DRESS CODE:  Shirt and shoes will be required to be worn at all times in the Caliente Front Office, Clubhouse, Annex and activity rooms.

 

S.                   TRAFFIC:  The speed limit shall be 10 miles an hour throughout the Park.  Stop signs in the Park

shall be adhered to.

 

 

T.            SOCIAL ACTIVITIES:  Social activities for Caliente residents will be announced at the

Monday and Thursday gathering of all residents at the Clubhouse for coffee at 9:00 a.m. and announcements at 9:30 a.m.  They will, also, be published in the monthly CHATTERBOX        and posted at the Clubhouse and Business Office.  The CHATTERBOX may be purchased at the Business Office or Clubhouse.

U.             WATER:  A water machine is located on the north side of the Clubhouse.  Bring your own

gallon jug.  A fee of 25 cents per gallon is charged.

 

V.            NEWSPAPERS:  Newspaper subscriptions can be ordered through the Park.  The Business

Office has the forms and will fax the subscriptions to the desired newspaper.  The newspapers pay

the park a commission for each subscription, generating additional revenue for the general fund.  Used newspapers should be placed in paper sacks (no plastic) and deposited in the paper room at Unit 2 North Laundry.  Any printed matter, except carbon paper, will be accepted for recycling.  Aluminum recycling is located at Unit 2 South Laundry.  Recycle containers are located in the Clubhouse, Annex and Front Office

 

W.          PROPANE:  Propane is delivered by commercial vendor to each lot.  “Propane Wanted”

signs and delivery schedules are available from vendor or the Business Office.

 

X.             MAIL:  Mailboxes are located near the Clubhouse.  Keys are issued at the Business Office.

Mailing address is:  Your name, street number and street name, Florence, AZ 85232.

(Example:  John Smith, 888 Saguaro Drive, Florence, AZ 85232).

 

Y.              FAX MACHINE:  A Fax machine is located in the Business Office at (520) 868-5146 or

at the Clubhouse at (520) 868-5340 during business hours.

 

Z.              OFFICE HOURS:

 

1.                    Business Office:  Hours 8:00 a.m. – 5:00 p.m., Monday through Friday;

from September 1st through May 31st.    During the Winter season, Saturday, 9:am – 12:00  noon.  During the summer, June 1st through August 31st 8:00 a.m. to 12:00 noon, Monday through Friday.

2.                    Clubhouse Office:  Hours are 8:00 a.m. – 4:00 p.m. Monday through Friday September 1st through April 30th.  These hours may vary according to activities.

CPOA RULES AND REGULATIONS

 

PARKING

 

A.                  GENERAL:  Owners or renters are required to provide space to park their primary transportation

vehicle (including pickups with campers, or van conversions) on their lot.  Vehicle shall not extend over the concrete strip.

 

B.                  STREET PARKING:  Parking on streets of Caliente is not allowed except for short a duration,

deliveries, pickups, or short-time visitors.  Based on the recommendation by the Florence Fire and Police Departments, the Parking Rules and Regulations are changed regarding overnight street parking.  There will be no overnight street parking.  Parking is permitted 12 hours a day – daylight hours only.  However,  evening guest parking is permitted.

               

                Enforcement:  Vehicles found to be in violation will be reported to the CPOA Board of

                Directors, who shall take any of the following:

               

1.                     - a written warning

2.                     - a twenty-five ($25.00) dollar fine

3.                     - have the vehicle removed at the owner’s expense

 

C.                  PARKING PERMITS:  Parking of vehicles of any kind, including utility trailer and car totes,

on lots other than your own will not be permitted without the written consent of the owner of said lot.  Permission forms and parking permits shall be obtained from the Business Office and must be visibly displayed in the parked vehicle.

 

D.         VEHICLE STICKERS:  Owner vehicle identification stickers and renter/guest temporary

vehicle passes are issued at the Business Office.  Owner shall place the sticker in the UPPER

LEFT corner of the windshield on the driver’s side.  A second ID sticker is optional to be placed on the left side of the rear bumper or window.  Renters and guests shall place temporary vehicle passes in the LEFT hand corner of the dashboard.

 

E.             SECOND VEHICLE:  A second vehicle (car, van, or pickup, not a recreational vehicle or motor home) may be parked in line with the primary vehicle so as not to obstruct the patio area.  All parked vehicles must clear the concrete strip in front of the lot.

 

F.              EXTRA EQUIPMENT:  No camper shell (off the truck), boat, secondary recreational vehicle

(excluding van conversion),  any road type vehicle or equipment may be placed or stored on any lot without approval of the Park Manager.  Golf carts, motorcycles, ATV’s, bicycles may be parked on a lot anytime. If there is sufficient space immediately behind the tow vehicle, car totes may be parked on the lot; otherwise they must be stored elsewhere.

 

G.            CLUBHOUSE PARKING:  Owners, renters and guests may park at the Clubhouse without

a parking permit during daylight hours or while attending evening/night functions.  Overnight parking will require a no-fee parking permit issued by the Business Office or Security when the Business Office is closed.  Overnight permits for residents may be issued for, but not limited to the following reasons:

               

While on a Clubhouse sponsored trip.

 

1.                    Preparing for early A.M. departure to not disturb neighbors.

2.                    When arriving after dark to avoid having to park in the dark.

H.            DRY-PARK:  Overnight guests, or prospective renters sleeping in an RV/motor home may

park at the Clubhouse parking lot if the Business Office is closed, for a fee of ten (10) dollars per night and must obtain a parking permit from a Security representative.  When the Business Office reopens, they must inquire at the Business Office for the availability of a rental lot.  If none is available, they must leave the Park.

 

I.               ADDITIONAL PARKING LOT:  Additional parking spaces for cars, pickups, utility trailers and

             vans are available for owners.  See Rules and Regulations for Temporary Parking Lot.

CPOA RULES AND REGULATIONS

 

TEMPORARY PARKING LOT

 

A.                  GENERAL:  Temporary parking lot(s) may be created by CPOA Board of Directors to

provide temporary overflow parking for residents of Caliente.

 

B.                  VEHICLE RESTRICTIONS:  Parking spaces will be limited to the following:

 

1.        Cars, pickups with or without camper shells or full size campers.

2.        Utility trailers

3.        Car totes

4.        Vans

5.        Boats on trailers only.

 

No camper shell may be taken off the truck and left in the parking area.  Motor homes, RV travel trailers or boats off the trailer are not allowed.  Maximum length is 20 feet – exceptions may be determined by the Park Manager. 

 

C.                  SHUTLE VEHICLES:  Golf carts, ATV’s, bicycles, mopeds, motorcycles, etc., may

be used as shuttle vehicles. However, they may not be left overnight.

 

D.                  REGISTRATION:  Residents shall apply at the Business Office for parking permits and

assigned parking space number.  Cost per winter season (September 1st through August 31st)

shall be fifty (50) dollars.

 

E.                   PARKING DECAL:  A special parking decal will be issued each winter season to identify

residents who have paid their current fees. These decals will be available at the time of payment and shall be affixed to the rear window in the upper left-hand corner on the driver’s side.

 

F.                   LIABILITY:  CPOA will not accept any liability resulting from vandalism, theft, damage of

any cause and/or acts of nature occurring to any vehicle parked in the temporary parking lot.  Applicants will be required to sign a Release of Liability form before they will be issued a parking decal.

 

G.                  ENFORCEMENT:  Unauthorized vehicles will be reported to the CPOA Board of Directors,

who shall take any of the following actions:

 

1.                    A formal warning.

2.                    A twenty-five (25) dollar fine.

3.                    Have the vehicle removed at the owner’s expense.

 

H.                  SPEED:  The speed limit inside the temporary parking lot shall be five (5) miles per hour.

 

I.                     TRANSFER:  Transfer of your rental agreement is not permitted.  However, you may let others park on your space, if you apply at the Business Office and the vehicle displays the proper decal or permit.  The cost of this permit will be $5.00.

 

J.           RENEWALS:  Renewal payments are payable in advance and are due before September 1st

each year.  Rental fees are not refundable.  If a leaseholder moves out of the Park or sells their lot during the rental year, their space will be offered to the next applicant on the waiting list.

CPOA  RULES AND REGULATIONS

 

      FACILITIES AND ACTIVITIES

 

 

A.                  GENERAL:  The following groups may use any/all of CPOA facilities and activities:

 

1.                    Residents, and/or Renters:  While residing on a rented lot, for which the lot assessment

is current, and their registered guests.

 

2.                    Non-resident Owners:  Meeting the age requirements, whose lot assessment is current

and whose lot is unoccupied. When a lot is rented (or loaned) to guests, the owner

relinquishes facility use privileges to the renter/guest.

 

B.                  ASSOCIATE MEMBERSHIP:  Non-residents of Caliente who are residents of Florence

Gardens Mobile Home Association, Vista Hermosa Homeowners Association, or Casita Hermosa

Homeowners Association may participate in facilities and activities by:

 

1.                    Fees:  Pay a ten (10) dollar annual membership fee to the Caliente Clubhouse to

participate in any one of the following activities:

 

Annex Movies                                      Wood Carving                      Silversmithing

Card Room                                            Billiards Room                      Stained Glass

Dance Classes                                      Pottery                                   Tole/Oil Painting

Quilting                                                  Ceramics

 

Note:  This excludes swimming pools, laundries, shuffleboard, Wood Shop and the Caliente weight/exercise room.  If over crowding occurs within any $10 activity, additional memberships will not be sold for that activity.

 

2.                    Events:  Attend events that require an admission fee.  They may, also, attend user-fee

paid events such as bingo, square dancing, church services, and college classes.

 

C.                  COMBINED ACTIVITY CLUBS:  Activity clubs, that are combined with other parks, may

use Caliente facilities.  User fees will be established by the Activity Director and approved by

the Board.

 

D.                  TICKET SALES:  To control the number of individuals attending Caliente Casa de Sol

Clubhouse functions, the following ticket sale policies are hereby imposed.

 

1.        Registered Residents:  Caliente owners in residence, renters and guests registered at the Caliente Business Office can purchase tickets to events at any time they are on sale.

 

2.        The following guidelines will be used for events:

 

a.        Hog Heaven – open to 4  parks when they go on sale.  Off sale morning of event.

 

b.       Thanksgiving Dinner/Christmas Dinner/Las Vegas Dinner/Prime Rib/Chops and/or Oyster – tickets will go on sale 21 days prior to event to Caliente residents, renters and guests.  Seven (7)  business days prior to event sales will open to other 3 parks.  Ticket sales will be closed three (3) business days before event.

c.        Other events – when necessary, will be established by the Activities Coordinator and/or Park Manager.

 

3.        Non-Residents:  Ticket sales to Florence Gardens Mobile Homeowners Association, Vista

Hermosa Homeowners Association and Casita Hermosa Homeowners Association, will be subject to availability of seating.

 

4.    Ticket sales to Saturday Breakfast and dances will be sold on a “first come” basis.

 

5.    Purchase Tickets:

 

a.             Owners, renters and properly registered guests must list their name and

              address on a roster.

b.              Individuals purchasing a group of tickets for authorized members, must

              list the name and address and present name tag for whom each ticket is

              purchased.

 

E.                   SWIMMING POOLS: 

 

1.                    General:
